Contracts of Employment

The Labour Relations Act (LRA) determines that a person whose services have been procured for, or provided to, a client by a Temporary Employment (TES) is the employee of that “TES”, and the “TES” is that employee’s employer. As such, all workers outsourced to a client remain the employees of Westpoint Trading cc and is bound by a contract of employment. The content and structuring of our contract of employment is compliant with legislation and has successfully stood up to challenges put forward through the CCMA and the Bargaining councils.

Predetermined standards of performance and evaluation procedures can be agreed upon between Westpoint Trading cc and a prospective client to ensure that all outsourced employees perform according to the required standards. Any disciplinary action required would be carried out according to Westpoint Trading cc Disciplinary Code, which is in accordance with legal standards.
